A legal disclaimer

Welcome to Donington Myers. These Terms & Conditions of Engagement govern the provision of new build snagging surveying services by Donington Myers to you, the client. By confirming a booking for a survey, you acknowledge and agree to be bound by these terms.
​1. Definitions
​"The Surveyor/Us/We/Our": Donington Myers, providing new build snagging surveying services.
​"Client/You/Your": The person(s) or entity engaging Donington Myers' services.
​"Property": The new build residential property subject to the Snagging Survey.
​"Snagging Survey": The non-intrusive, visual inspection of the Property to identify defects (snags), omissions, and quality issues against applicable standards.
​"Report": The written document provided to the Client detailing the findings of the Snagging Survey.
​"Holding Deposit": The non-refundable amount of £99 required upon booking confirmation.
​2. Appointment and Acceptance
​2.1. A legally binding contract for the provision of the Snagging Survey Services is formed when you confirm your booking (via our website, email, or telephone) and we receive the required Holding Deposit.
​2.2. By confirming a booking, you confirm that you have read, understood, and accept these Terms & Conditions.
​3. Fees and Payment
​3.1. Our quoted fee for the Snagging Survey is payable as follows:

a. Holding Deposit: A non-refundable Holding Deposit of \text{\pounds}99 is required immediately upon booking confirmation to secure your inspection date and time. This is highlighted here: A non-refundable Holding Deposit of \text{\pounds}99 is required upon booking confirmation. This deposit is deducted from the total survey fee.
b. Remaining Balance (Post-Survey Payment): The outstanding balance of the full survey fee will be invoiced to you immediately following the completion of the Snagging Survey at the Property.

3.2. The Report will not be released to the Client until the full outstanding balance has been settled and the payment is confirmed as cleared.
3.3. If the Surveyor is denied access, refused entry, or the inspection is aborted due to circumstances beyond our control (e.g., site access issues, developer delays, unsafe conditions), the Holding Deposit is forfeited, and a reasonable proportion of the full fee may be charged to cover lost time and expenses, up to 50\% of the total fee.
4. Client Obligations and Access
4.1. You are solely responsible for obtaining and confirming all necessary permissions for the Surveyor to access the Property, including agreement from the developer/site manager/current owner.
4.2. You must ensure that the Property is safe, clear, and fully accessible at the agreed inspection time. The Surveyor will conduct a visual inspection only; we will not move furniture, lift carpets, or access restricted areas.
4.3. You warrant that you have full legal right to commission the Snagging Survey.
5. Scope and Limitations of the Snagging Survey
5.1. The Snagging Survey is a visual inspection of the accessible areas of the Property on the day of the inspection only.
5.2. The inspection will identify items of snagging (minor defects, omissions, or issues with workmanship that do not meet accepted tolerances or finish) but is not an invasive or destructive investigation.
5.3. The Surveyor will not test the functionality of systems, appliances, or services (e.g., electrical wiring, heating systems, or plumbing) beyond a basic visual check. We rely on the developer's certification for the safe and proper installation of services.
5.4. The Report is based on the condition of the Property at the time of the inspection. Donington Myers accepts no liability for changes in condition after the inspection date.
5.5. The Report is prepared solely for the confidential use of the Client and should not be relied upon by any third party without our express written consent.
6. Cancellation and Amendments
6.1. Cancellation by the Client:
a. If you cancel your booking more than 48 hours before the scheduled inspection, the Holding Deposit of \text{\pounds}99 is retained but no further payment is due.
b. If you cancel less than 48 hours before the scheduled inspection, you will forfeit the Holding Deposit, and a further cancellation fee of 50\% of the remaining balance will be payable.
6.2. Rescheduling: If you need to reschedule, you must provide a minimum of 48 hours' notice. The \text{\pounds}99 Holding Deposit will be carried over to the new booking. Rescheduling with less than 48 hours' notice will result in the forfeiture of the \text{\pounds}99 Holding Deposit, and a new deposit will be required to secure the revised date.
6.3. Cancellation by Donington Myers: In the unlikely event that Donington Myers must cancel the appointment, we will offer to reschedule or provide a full refund of all monies paid, including the Holding Deposit.
7. Liability
7.1. Donington Myers’ total aggregate liability to the Client arising out of or in connection with the Snagging Survey or the Report shall not exceed the total fee paid by the Client for the service.
7.2. Donington Myers is not liable for any structural, legal, or financial advice. We recommend you seek independent legal and financial advice concerning your new build purchase.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of [England and Wales/Scotland/Northern Ireland - Choose one based on where you are registered], and the parties submit to the exclusive jurisdiction of the Courts of [England and Wales/Scotland/Northern Ireland].
